Terms of Use

1. User Eligibility and Conduct

By using CreatorCaster, you represent that you are at least 18 years of age. You agree to:

  • Maintain the security of your own passwords and devices.
  • Comply with all laws, including FTC disclosure requirements for sponsored content.
  • Not copy, modify, or damage the Software.

2. Content Ownership and Licensing

  • Ownership: You warrant that you own all content you publish and that it does not infringe on any third-party intellectual property rights.
  • Usage Grant: Influencers grant an unlimited, worldwide, irrevocable, and perpetual license to use, reproduce, and distribute campaign content across all media formats, to CreatorCaster, Party Plan-It, Inc., and the Company that has hired CreatorCaster to manage influencer campaigns or other marketing services on their behalf.
  • Minors: If content features minors, you are responsible for obtaining written permission from a legal guardian.

3. Payments and Disclaimers

  • Compensation: All campaign payments are made directly from the Company, utilizing CreatorCaster's services, to the Influencer. CreatorCaster is not responsible for facilitating or guaranteeing these payments.
  • Service Continuity: We reserve the right to modify or discontinue the Software at any time without notice.
  • Termination: We may remove any user at our sole discretion for any reason, including misuse or breach of contract.

4. Liability and Jurisdiction

  • No Warranty: The Software is provided "as is" without warranties of any kind regarding availability or accuracy.
  • Indemnification: You agree to indemnify and hold harmless CreatorCaster and Party Plan-It, Inc. from any claims arising from your use of the Website or our Services.
  • Governing Law: These terms are governed by the laws of the State of California. Any legal disputes shall be settled exclusively in courts located in San Diego, California.
